Dana Wefer is committed to the preservation of free speech rights in NJ. Ms. Wefer argued and prevailed in Mazdabrook Commons v. Khan before the NJ Supreme Court, a case that held that people who live in community association’s have the right to post political signs in their windows, even if they are subject to a declaration of covenants and restrictions that states otherwise.
Ms. Wefer has successfully defended victims of Strategic Lawsuits Against Public Participation (SLAPP suits). SLAPP suits are frivolous defamation suits brought against people in order to silence them from speaking out on matters of public concern. Examples include politicians suing critics for defamation and developers suing local activists for defamation. Ms. Wefer wrote the article "SLAPPing Back: Responding to Strategic Lawsuits Against Public Participation," which was published in the New Jersey Law Journal on February 12, 2016.
Your rights to free speech are greater under the state constitution than they are under the federal constitution. Under the NJ State Constitution, your right to political free speech extends to private property if the private property has held itself out as a public square.
